Cinncinatus: exactly right with the "basis of the defendednts pleading guity" issue

I got pulled over near my house " builtup area" so its 50k's.
Went around a roundabout, fried 2nd gear, hit 3rd at aaround 7g's.
cop comming the other way turns around and pulls me over.

1)

first thing the cop says is...
cop: you do know it's a 50k zone here..
me: yeah.... i know
cop: why were you doing 82
me: umm nope I was only doing 50kmph
cop: you were only doing 50?
me: yes 50 it's a build up area

at this point they are furious they didnt get you for speeding. Because they have NO PROOF.

so what do they do? go over your car with a fine tooth comb.

they didn't find anything wrong with the car......

they got me for not changing my address on my license.

about 8 months and 3 weeks ago I got done for 147 in a hundredzone.
not cool, got $900 and 9 months.

Lesson learnt, done speed, and sell your turbo car.

bad luck with the whole license thing, iv'e been there done that

I also have a friend the was caught dragging from 0-80kmph
If i remember correctly he was fined under something called "Time trials"(Basically dragging)

he plans to plead guilty
it will be interesting to see what he gets, compared to yours
which court did you have to goto by the way?

It is all well and good to say we should have gotten a lawyer, and that may work in mexico! but, by the letter of the law up here, the ONLY evidence they require, with relation to racing/hooning, is their reasonable opinion...tell me, how many lawyers will it take to prove that the police orificer's opinion isn't reasonable?

As draconian as you seem to think the laws are, we still live in a free country. Maybe i'm a stupid new south welshman, but i simply can't believe that an opinion is enough to ruin the lives of 2 men. A lawyer might have been able to help.

If its their opinion which really matters you might have been able to argue that the opinion of a police officer whom would ignore a beating, under age drinking and a plethora of other offences (your story bud, you claimed to have witnessed it all) isn't worth much.

The laws are laid out up here such that an alleged "hoon" has nothing to stand on - its what happens when the media gets ahold of something and gets the opinions of an irate public without giving all the facts.

I've read some court transcripts, and seen people go down having had a lawyer PROVE that the car in question and driver could not be identified as being part of an illegal act...the guy still went down for it.

its not that your comments are bugging me, its that your comments are compounding the fact that the laws up here are so incredible retarded to the point of being absolutely unfair......so unfair that you cannot, no matter what you do, mount a defense....

Interestingly enough, it doesn't cost anything to sit (well, stand ) in the "public gallery" and watch what goes on. So if anyone wants to see what we witnessed in court, go right ahead one saturday morning you are bored. It's quite an eye opening experience, and leaves you dumbfounded at best. Actually it's given me quite a heavy dispise for drunk and dangerous drivers knowing now how they virtually get off with a slap on the wrist after what I've been through...

If an officer wants to prove his/her story then a little poetic licence goes a long way after a guilt plea. As stated though neither vehicle was capable of the aleged actions.

Take some time and visit the Magistates court and judge for your self how laws are applied. Then pop down to your state house of reps to see how the laws are made. You'll want to screem out 'WHY DO I VOTE FOR YOU DICKHEADS!'

i know how the law is applied i was once in an accident when a fellow drunken driver T-boned me and my father into a power pole....the law is shat and so are the people who inforce it...its never done me any favours the drunken driver got a $900 fine and 6 months suspension of his licence...meanwhile my dad had a crushed ankle because the engine went through the firewall, a chipped vertabrae which thankfully healed well and 2 months in hospital...the cops said the only thing that saved him was the fact that were in a old Dato 1800 made of metal and not plastic
