You shoudl investigate claiming against the party that hit you for the difference between you're insurance payout and the "real" replacement value of your car.

At the end of the day your insurer will have done a deal with theirs for the value listed on your policy (less the value of the wreck you now have). It's you right to seek the difference from their insurer.

You may not win but a well worded letter and some legal advice may go a long way.

From memory you need to spell out that you accepted a payout from your insurer for value XX due to the immediate need for $$ and that you consider your actual loss to be a total of (more than what you got). You are then seeking to claim this difference.

In fact your insurer may even help you with this.

If you had for example made a claim directly against the person that rearended you you may be further ahead than by using your own insurer. They would generally inspect your car and make you a repair or settlement offer that you could haggle up etc. Whereas your company only has to pay you whats on the contrcat you have with them. (and if it's market value you stand a very real chance to be screwed)

A.
